Emoji Day Promotion Official Rules

No purchase necessary to enter or win.  Void where prohibited.  Entry into the promotion constitutes your acceptance of these official rules.

Prizes subject to promotions promoted by ExpressVPN as described herein (“Promotion”) will be awarded in accordance with these Official Rules.

1. Promoter.  The promoter is ExpressVPN, which can be found at https://www.expressvpn.com.  This Promotion is in no way sponsored, endorsed, or administered by or associated with Twitter or Instagram.
2. Eligibility.  No employee(s) of ExpressVPN or any of their family members or anyone else connected in any way with the Promotion or helping to set up the Promotion is permitted to enter the Promotion. There is no entry fee and no purchase necessary to enter this Promotion.  Existing customers of ExpressVPN may enter. Entrants must be at least 18 years of age or older as of the time of entry.  ExpressVPN reserves the right to disqualify any entrant from the Promotion if it is prohibited in the entrant’s jurisdiction and does not accept responsibility for entries not received for whatever reason. 
3. How to Enter. NO PURCHASE NECESSARY TO ENTER OR WIN.  To enter the Promotion: (1) for Instagram: like the Promotion post, reply to the Promotion post with your favourite VPN emoji option, and follow @ExpressVPN on Instagram; (2) For Twitter: Like the Promotion tweet, reply to the post with your favorite VPN emoji option, and follow @ExpressVPN on Twitter.
4. Winners and Prizes.  A total of six (6) winners will be selected by ExpressVPN from each of Instagram and Twitter, respectively (“Winners”). The Winners from each of Instagram and Twitter will be randomly selected. Each Winner will receive a 12 month subscription of  ExpressVPN’s VPN service (each a “Prize”) . No cash alternative to the Prizes will be offered. The Prizes are not transferable. Prizes are subject to availability and ExpressVPN reserves the right to substitute the Prize with another of equivalent or less value without giving prior notice.
5. Promotion Schedule.  The entry opening date is July 15, 2021 00:01 a.m EDT (“Opening Date”) and the entry closing date is  Aug 1, 2021 11:59 p.m. EDT (“Closing Date”) for the contest. Promotion schedule is subject to change without prior notice.  Entries made after the Closing Date will not be permitted or recognized.
6. Number of Qualified Entries / Odds of Winning. Odds of winning are dependent on the number of entrants and the number of entries. Only the first comment or retweet per entrant on each social media channel will be considered as a qualified entry. 
7. Rules Modifications. ExpressVPN reserves the right to cancel or amend the Promotion and these terms and conditions without notice.  ExpressVPN’s decision in respect of all matters to do with the Promotion will be final and no correspondence will be entered into. 
8. Winner Notification. The Winners will be notified by direct message via the social media channel from which they entered within 28 days of the closing date. Each Winner is subject to validation and verification of eligibility and compliance with these Rules and Terms and Conditions.  If a potential winner is disqualified or cannot be contacted or does not claim the prize within 14 days of notification for any reason, ExpressVPN reserves the right to withdraw the prize from the winner and pick a replacement winner.  ExpressVPN will only display the Winner’s public social media handle and/or first name and last name initial in the Promotion post. 
9. Prizes and Approximate Retail Value.  Each Prize awarded in this Promotion, a 12 month VPN subscription by ExpressVPN, is approximately US$156.00 based on manufacturer suggested retail price (MSRP) (each a “Prize”). The Prizes are awarded “as is” with no warranty or guarantee, either express or implied by ExpressVPN and are also subject to ExpressVPN’s Terms of Use for the VPN service.
10. Privacy.  Entrants agree that personal data of the entrant, including name, username, mailing address, phone number, and email address may be collected, processed, stored and otherwise used by ExpressVPN and each of its affiliates for the purposes of conducting and administering the Promotion.  No other personal data relating to the winner or any other entrants will be used. If the entrant also suggests their own VPN emoji combination, ExpressVPN may share the Winners’ #VPNemojis publicly in the respective social media channels or other channels, the Winners hereby waive their moral rights to their #VPNemojis and give explicit consent to ExpressVPN to use and publish the winning #VPNemojis without limitation. All personal information that is collected from each entrant is subject to ExpressVPN’s Privacy Policy, with respect to use by ExpressVPN. 
11. Governing Law. By entering the Promotion, each entrant agrees, except where prohibited, that (1) any and all disputes, claims and causes of action arising out of or connected with the Promotion, or any prizes awarded, shall be governed by the laws of Singapore and resolved individually, without resort to any form of class action, and exclusively by the courts of Singapore, and each entrant hereby waives any and all objections to jurisdiction and venue in these courts and hereby submit to the jurisdiction of those courts; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event will attorneys’ fees, costs or expenses be awarded or recoverable; (3) under no circumstances will an entrant be permitted to obtain any award for, and each entrant hereby knowingly and expressly waives all rights to seek, punitive, incidental, special, consequential or any similar damages, including, without limitation, lost profits and each entrant further waives any and all rights to have damages multiplied or otherwise increased. The remedy for any claim hereunder shall be limited to actual damages and in no event shall an entrant be entitled to recover punitive, exemplary, consequential or incidental damages.
    

12.  Release.  By participating in the Promotion, You accept and agree to these Rules and the decisions of ExpressVPN, which shall be final and binding in all matters. By participating in any Promotion, You agree to release and hold ExpressVPN, Twitter, and Instagram harmless against any and all claims and liability arising, in whole or in part, directly or indirectly, out of participation in the Promotion or use or redemption of a prize. The releases hereunder are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims.
